By accessing, browsing, or placing an order on merchgoneviral.com, you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service in their entirety. These Terms constitute a legally binding agreement between you and Merch Gone Viral. If you do not agree, you must immediately discontinue all use of this website.

This website is owned and operated exclusively by Merch Gone Viral, registered at 329 Howe St, Unit #511, Vancouver, BC V6C 3N2, Canada. By accessing this website, you confirm that you are at least the age of majority in your jurisdiction and possess the legal capacity to enter into binding agreements. Merch Gone Viral reserves the absolute and unconditional right to refuse service, terminate accounts, cancel orders, or restrict access to any person or entity at any time, for any reason, without prior notice. You expressly agree not to reproduce, duplicate, copy, sell, resell, scrape, or exploit any portion of this website without prior express written authorization.

02 · Accuracy of Information

Merch Gone Viral makes every reasonable effort to ensure all product descriptions, pricing, and content are accurate. We reserve the right to correct errors and cancel any order placed on the basis of inaccurate information without liability. Product images are for illustrative purposes only; colour variations due to monitor calibration are not grounds for a return or refund.

03 · Orders & Payment

By placing an order, you represent that you are of legal age, fully authorized to use the payment method provided, and that all information submitted is accurate and truthful. Payment is collected immediately and in full at checkout. All prices are in USD. There are no hidden fees of any kind. Merch Gone Viral reserves the right to cancel, refuse, or hold any order that appears fraudulent or in violation of these Terms. Receipt of an order confirmation does not constitute acceptance; we reserve the right to cancel any confirmed order prior to shipment.

04 · Order Processing & Shipping

All orders are processed within 1–3 business days (Monday–Friday, 9:00 AM–5:00 PM PST), excluding public holidays. Estimated delivery from date of shipment:

• United States & Canada: 7–21 business days — Free shipping
• International: 7–21 business days — $9.95 USD flat rate

All timeframes are estimates only. Merch Gone Viral disclaims all liability for delays caused by customs, carrier disruptions, natural disasters, or any circumstances beyond our control. International customers are solely responsible for all customs duties and import taxes.

05 · Customer Delivery Responsibility

It is the sole responsibility of the customer to provide a fully accurate, complete, and accessible shipping address at checkout — including unit numbers, buzzer codes, and all access instructions. Merch Gone Viral bears no liability for failed deliveries resulting from an incomplete or inaccurate address. No refund, replacement, or reshipment will be issued under such circumstances.

06 · Post-Delivery Responsibility & Lost or Stolen Packages

Once a shipment is confirmed as delivered by the carrier's official tracking system, all responsibility transfers fully and irrevocably to the recipient. Merch Gone Viral bears zero liability for any package confirmed as delivered and will not issue any refund, replacement, or credit under any circumstances.

07 · Customer Responsibility — Colour & Size Selection

It is the sole responsibility of the customer to select the correct size, colour, and variant before completing their purchase. Orders placed with an incorrect selection are not eligible for return, exchange, or refund. Colour variations due to monitor settings are not grounds for a claim.

08 · Returns, Refunds & The Mandatory Verification Process

Customers have a 30-day window from confirmed delivery to initiate a claim. No return, refund, replacement, or store credit will be issued prior to completion of our mandatory verification process.

Step 1 — Submit Your Claim

Email info@merchgoneviral.com within 30 days with: full order number, detailed description, high-resolution photos, and video evidence.

Step 2 — Internal Review

Our team reviews complete submissions within 3–5 business days and notifies you in writing.

Step 3 — Approved Resolution

• Full Complimentary Re-shipment: Correct item reshipped at zero cost — our preferred resolution.
• Approved Refund: Processed within 3–10 business days to the original payment method only, upon receipt of returned item with valid RA number.

Non-Returnable & Final Sale Items

• Underwear, lingerie, and intimate apparel
• Swimwear and bikinis
• Hosiery, tights, and socks
• Face masks, skincare, cosmetics, and beauty products
• Pierced jewelry and earrings
• Opened hair accessories, perfume, and personal care products
• Any Final Sale item, or any item worn, washed, altered, or returned without original packaging and valid RA number

09 · Fraudulent Claims & Abuse

Merch Gone Viral maintains an absolute zero-tolerance policy toward fraudulent claims and unjustified chargebacks. Offenders will be permanently banned and reported to law enforcement and payment processors. We reserve the right to pursue all available civil and criminal legal remedies including claims for damages, legal costs, and injunctive relief.

10 · Limitation of Liability

To the fullest extent permitted by applicable law, Merch Gone Viral shall not be liable for any indirect, incidental, special, consequential, or punitive damages. In no event shall our total liability exceed the total amount paid by the customer for the specific order giving rise to the claim.

11 · Intellectual Property

All content on this website is the exclusive intellectual property of Merch Gone Viral, protected under US, Canadian, and international copyright and trademark laws including the Berne Convention, TRIPS Agreement, and DMCA. No content may be reproduced or used without prior express written consent.

12 · Data Protection & Privacy

13 · Disclaimer of Warranties

Disputes shall first be submitted to good-faith negotiation prior to any formal legal proceedings.

If any provision of these Terms is found unlawful or unenforceable, it shall be deemed severable and shall not affect the validity of remaining provisions.

17 · Modifications to Terms

Merch Gone Viral reserves the right to update these Terms at any time. Continued use of this website constitutes acceptance of the revised Terms.
