Merch Gone Viral reserves the right to refuse service to any person or entity at any time, for any reason, without obligation to provide explanation. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of this website, its content, or its services without express written permission from Merch Gone Viral. We reserve the right to modify, suspend, or discontinue any product, service, or portion of this website at any time without prior notice or liability.

2. Accuracy of Information

While we make every effort to ensure the accuracy of information presented on this website, Merch Gone Viral does not warrant that product descriptions, pricing, availability, or other content is complete, current, or error-free. We reserve the right to correct any errors and to cancel orders placed based on inaccurate information, including incorrect pricing, without liability to the customer.

3. Orders & Payment

By placing an order, you represent that you are of legal age in your jurisdiction and are fully authorized to use the payment method provided. All orders are subject to acceptance, availability, and payment verification. Merch Gone Viral reserves the right to cancel, refuse, or limit any order at its sole discretion, including but not limited to orders that appear fraudulent, abusive, or in violation of these terms. Full payment must be received and verified before any order is processed or shipped. Prices are displayed in USD and are subject to change without notice.

4. Shipping, Delivery & Customer Responsibility

Orders are processed within 1–3 business days (Monday–Friday, 9:00 AM–5:00 PM PST, excluding Canadian public holidays). Estimated delivery is 7–21 business days from the date of shipment, depending on the destination country and carrier. All delivery timeframes are estimates only and are not guaranteed. Merch Gone Viral shall not be held liable for delays caused by customs processing, carrier disruptions, weather events, or circumstances beyond our control.

Customer Delivery Responsibility: It is the sole and complete responsibility of the customer to provide a fully accurate, complete, and accessible shipping address at the time of checkout. This includes, without limitation: the correct recipient name, full street address, unit or apartment number, buzzer or intercom access codes, building entry instructions, and any special delivery instructions required by the carrier or building management. Merch Gone Viral shall bear no liability whatsoever for failed deliveries, returned packages, or undeliverable shipments resulting from an incomplete, inaccurate, or inaccessible address provided by the customer. No refund or replacement will be issued in such circumstances.

Post-Delivery Responsibility: Once a shipment has been marked as delivered by the carrier’s tracking system, Merch Gone Viral’s responsibility for that order is fully discharged. In the event that a customer reports non-receipt of a package that has been confirmed as delivered, the customer must: (1) thoroughly check all delivery locations on the property including mailboxes, parcel lockers, reception areas, and with neighbours or building management; (2) contact the carrier directly using the tracking number provided in their shipping confirmation email to open a formal investigation; and (3) if theft or loss is suspected following confirmed delivery, file an official report with their local police department or law enforcement authority and provide Merch Gone Viral with the report number upon request. Merch Gone Viral shall not be held responsible or liable for packages confirmed as delivered by the carrier, and no refund or replacement will be issued solely on the basis of a customer’s claim of non-receipt following carrier delivery confirmation.

5. Returns, Refunds & Verification

Please refer to our full Refund Policy for complete details. All return and refund requests are subject to a mandatory verification process. The following conditions apply without exception:

• Return requests must be submitted to info@merchgoneviral.com within 30 days of the confirmed delivery date.
• The customer must provide their order number, a detailed description of the issue, and clear photographic or video evidence of any damage or defect at the time of the request.
• All return requests must be approved by Merch Gone Viral prior to the customer shipping any item back. Items returned without prior written authorization will not be accepted and no refund will be issued.
• Items must be returned in their original, unused, unworn, and unaltered condition with all original packaging and tags intact.
• The customer is responsible for return shipping costs unless the item is confirmed defective or incorrect.
• A valid carrier tracking number must be provided for all return shipments. Merch Gone Viral shall not be responsible for items lost in transit during return shipping.
• Refunds will only be processed after the returned item has been physically received, inspected, and verified by Merch Gone Viral. Refunds will not be issued prior to receipt and inspection of the returned merchandise.
• Merch Gone Viral reserves the right to deny any refund request that cannot be substantiated with adequate evidence, or where the returned item is found to be used, damaged by the customer, or not in its original condition.

6. Fraudulent Claims & Abuse

Merch Gone Viral maintains a zero-tolerance policy toward fraudulent claims, chargebacks, and abuse of our return and refund process. Any customer who submits a false, misleading, or unsubstantiated claim of non-delivery, damage, or defect with the intent to obtain a refund, replacement, or financial benefit without legitimate cause will be permanently banned from purchasing on this website. Merch Gone Viral reserves the right to report fraudulent activity to the relevant law enforcement authorities and to pursue all available legal remedies, including civil and criminal action, to recover losses resulting from fraudulent chargebacks or claims.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Merch Gone Viral shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages of any kind arising from or related to your use of this website, our products, or our services, including but not limited to loss of profits, revenue, data, goodwill, or business opportunities. In no event shall Merch Gone Viral’s total cumulative liability to any customer exceed the total amount paid by that customer for the specific order giving rise to the claim.

8. Intellectual Property

All content on this website, including but not limited to text, product descriptions, images, logos, graphics, and design elements, is the exclusive property of Merch Gone Viral and is protected by applicable Canadian and international copyright, trademark, and intellectual property laws. Any unauthorized reproduction, distribution, or use of our content is strictly prohibited and may result in legal action.

9. Governing Law & Jurisdiction

These Terms of Service shall be governed by and construed exclusively in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms shall be resolved exclusively in the courts of competent jurisdiction located in British Columbia, Canada, and you hereby irrevocably consent to such jurisdiction.

10. Modifications to Terms

Merch Gone Viral reserves the right to update, amend, or replace any part of these Terms of Service at any time at our sole discretion. Changes will be effective immediately upon posting to this page with an updated date. Your continued use of this website following the posting of any changes constitutes your binding acceptance of the revised Terms of Service.
